My daughter has twins and the father has made one child support payment in the two years of thier lives. He says he love the twins, but fought tooth and nail to have his payments dropped from the original 850 to 450 then got another 100 off by allowing them to drop his last name from the birth certificate. So he has made one payment of 350 six months ago and has to pay back support of 11,000. He makes good money. but will not pay. Now he has quit his job and is working under the table for the same company. The state is not helping. Can I give her the money and sue him? Can I turn him in to the IRS for not paying taxes? Any suggestions that won't land me in Jail? Becouse, I have already thought of those things after he hit her.

File with your State's Child Support Enforcement Department -- look it up in your Local Phone book.

YOUR daughter will need to do the filing with YOU (sounds like you may have custody?). She will need to provide the information on HER income, personal information, and every piece of information that she has on the "Alleged" father of the children (which can include the previous salary of his position).

Just because he 'quits' and 'complains' does NOT validate the child support amount or allocation. With the Filing, you request that the State go for a MODIFICATION in the Child Support, and they WILL Take into consideration the AVERAGE income he is ABLE to make ... and that does NOT mean that his latest ploy to AVOID child support is going to work! He MAY find that the Child Support is HIGHER now because they will NOT believe his 'lower' salary given his employment history (quite a common ploy for those trying to avoid child support by the way). They will also be able to file for the Intercept of his Tax Refunds or other Government Pay/Benefits (and even with his employer too under certain circumstances) .. and will do this FREE!!!!

PS -- if he is Abusing your Daughter -- then be WITH HER and FILE The Domestic Violence Charges when he does this !!!!!!!!

No you can't sue him. He is responsible for his children's welfare, he is accountable for their upbringing. The law is obligated to hold him accountable for financial responsibility of his children, I also had in the back of my mind that he is working under the table and not paying taxes, I would go to the IRS and report him for child financial neglect and ask them what to do. As well as tax evation. They will take it from there. Contact childrens services to speed up the process. and make sure you tell them of the abuse, so they can take preventative measures. call the local Child Support commission where you are, or social services, ask them what can be done, he's so far behind that either he pays or he goes to Jail!

call the child support. Sue him and turn him in.
