if a person excepts severance package from his employer, will he be able to file for unemployment benefits.

When I was laid off back in October 2002, my former employer told me that I could go right to the unemployment office and start collecting. There was no reduction in my severance because of my collecting unemployment. In fact, I didn't receive my severance for up to 6 weeks after my termination, so I was fortunate the unemployment checks were coming in.

Accepting a severance package does not by itself keep you from collecting unemployment, but it will most likely reduce the payment amount and/or delay when you can start receiving benefits.

They have to report the severance package to EDD. The forms you complete clearly ask if you have received severence or vacation pay. Your employer will report it. Generally you penalized for a few weeks of no unemployment when you receive severance or vacation pay from an employer.

You could still collect unemployment, but you have to use your severance first........it may just delay the start time........but don't think that you can coast and not look for employment....it isn't a way to get ahead.

In Ohio, you may report for Unemployment advantages, yet they're going to deduct your severance volume from the Unemployment, meaning, that you'll get carry of the unemployment after the severance runs out.
