Likely they would get auditted and fined for falsifying their tax documents. because no matter how they choose to see a fetus, the government doesn;t recognize that child until it is out of the womb.

Legally they have to be born. Babies out of the womb need so much more than babies within the womb. The govt though is nice enough that even if we have our kid in the last second of a year, we get to claim them on our taxes for the WHOLE year! So technically, we do get to claim them as a dependent while they are unborn!

They would eventually be prosecuted by the IRS for tax fraud. No government anywhere recognizes the rights of any unborn person. The US does not recognize any child as a dependent before they are born.

Legally, the pro-lifer has no recourse here.

BTW, I'm very pro-life. (Just in case you couldn't guess.)
