887. ART. 87. MISSING MOVEMENT
Any person subject to this chapter who through neglect or design misses the movement of a ship, aircraft, or unit with which he is required in the course of duty to move shall be punished as a court-martial may direct.

885. ART. 85. DESERTION
(a) Any member of the armed forces who--
(1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;
(2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or
(3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another on of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States; is guilty of desertion.
(b) Any commissioned officer of the armed forces who, after tender of his resignation and before notice of its acceptance, quits his post or proper duties without leave and with intent to remain away therefrom permanently is guilty of desertion.
(c) Any person found guilty of desertion or attempt to desert shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct, but if the desertion or attempt to desert occurs at any other time, by such punishment, other than death, as a court-martial may direct.

892. ART. 92. FAILURE TO OBEY ORDER OR REGULATION
Any person subject to this chapter who--
(1) violates or fails to obey any lawful general order or regulation;
(2) having knowledge of any other lawful order issued by any member of the armed forces, which it is his duty to obey, fails to obey the order; or
(3) is derelict in the performance of his duties;
shall be punished as a court-martial may direct.

Apparently not.. That Army LT's court martial ended in a mistrial. But he's an officer. I'm sure if an enlisted military member refused he'd be hung out to dry.

Yes it's illegal. When you volunteer you sign a contract to do as you are ordered, and regardless of what liberals say this war is legal. Congress voted to authorize it and the Commander in Chief ordered it.

DUH !!

The instant you sign on that dotted line, the army own you completely - body and soul.

They tell you to jump - you say "how high sir?"

Anyone joining the military today must KNOW there is a MORE THAN HIGH % that they will be deployed to Iraq, (even though AFGHANISTAN is the REAL SOURCE of this latest terrorism conflict NOT Iraq) and any other country USA choose to invade contrary to International law or advice.

Simple as.

If you didn't know that, and you are accepted into the army, it sure explains a hell of a lot. !! (the term cannon fodder springs to my mind !!)

Y E S, when you volunteer for the US Armed Forces, you WILL OBEY all orders of those
people who are superior in rank over you.
Failure to do so is wrong and you will be Court-Martialed.

Yes.... the military is not like a regular job that you can pick and choose what you want to do... the supreme court agrees with that view.
