I'm not an accountant or tax professional, but I've filed my own taxes for the last 30 years. If you have the numbers needed (gross pay, fed and state tax withheld, etc., from your pay stub, for example) and you file electronically, you don't have to have the W-2's in hand, but you should make sure you get them for your records. If the numbers you use turn out to be off, you could file an amended return. (If they're off by $5, I wouldn't bother. If they're off by $500, you should probably file an amended return. Where do you draw the line? Feeling lucky?) I think it all depends how much money is involved. I don't think the IRS is going to spend a couple of days of an employees time to recover $20 in taxes due. But W-2 info is reported to them.

If you file a paper return, all W-2s must be attached. If you e-file, the e-file provider is legally required to obtain W-2s before submitting your return. If you knowingly omit any income, you are guilty of tax fraud. The IRS says that if you don't receive your W-2 by Feb 15, you should contact the IRS at 1-800-TAX-1040. If you are that desperate for cash, you need a BUDGET, not a tax refund.

It is better for your to wait for all w5 and 1099 and file after that. If you file now without all w-2, there is no legal problem except that you need to file again an amended return 1040x, when you receive the missing w-2.

You can file now without it, but it's better to wait if you can! But if you can't than you would definately have to do an amendment when you receive it or you may have to face an audit, and that is definately something you don't want to deal with!
