basically, hired an after school carer to look after our daughter (5yrs old), after 3 days in her care my daughter told me this person had been leaving her locked in the car unsupervised whilst going into schools to pick up other children. told carer that we would not require her services & informed ofsted.
we had paid 1 mnth money in advance and now she wants money for the 4 week notice period that we obviously didn't serve her.
what do we do?

Not sure what area you are in - UK? I can tell it is not US by your use of whilst.

Do you have a contract with her? What does the fine print state? Contact a free legal service and see what they can help you with. Look up "breach of contract" and see what you can find. She obviously didn't do her job well, but that may not be the issue with the contract. You paid her to watch your daughter - did the contract specify HOW - as in not leaving her alone in a car and out of her sight? This is where things get tricky. A judge could say "she was still minding her, just not up to your expectations." Do you know what I mean? I would hope that parents wouldn't find care like that acceptable, but heck - some parents leave their kids in the car in HOT weather to go to the casino (happened in Australia) and others to get their hair done (happened in Michigan, USA). Some people find that acceptable while others do not.

I would tell her to piss off and that if she keeps pestering you that you will take her to court to get your prepayment back AND report her to whatever authority is in charge of licensing her.

I'm a registered childminder and cannot believe these people who put children in danger and tarnish our usually good reputation. She should be ashamed and you should definately report her to Ofsted in your in the U.K. You owe her nothing, she's damned lucky you haven't asked for the rest of the months money back. I think you've had a lucky escape.

That is despicable of her. Do everything you can to stop her from child minding. This is not a responsible carer. Don't pay her any money.

I think you've got a strong case for negligence and misconduct. Lets just say, if an employers catches someone with their 'hand in the till' you don't need to give the notice period before getting rid of them.

i would not pay as she left your child unsupervised in a car on her own i think she needs reporting so she loses her license, she was not doing her job of child minding..worst case scenario somebody could have taken your daughter from the car, thank god that never happened

DO NOT PAY HER !!! contact social service if she is watching other children they can be in dager as well ..I f you know the parent s call them

Just ignore her , if she persists tell her to take you to court .
She wouldnt have a leg to stand . Dont worry about it any more .

I was under the impression she was supposed to be child minding, don't pay her she was not doing what you agreed.

File a police report and have no further contact with her.

i would not pay! tell her she's lucky you haven't contacted social services about her never mind ask for more money!
