If you can prove to the authorities that they are dealing drugs,in the presence of the child,then I would think that you have an excellent case for custody.Neither are responsible adults.A child who is exposed to this sort of environment,which is unnatural,unhealthy and could prove very dangerous.If that child happens to get into contact with drugs,it doesn't bear thinking about.It would appear that the woman is unfit to be a parent.A responsible parent will always put their child first and above everything.

is your ex doing the drungs? if the guy she was living with is in jail for dealing drugs that is a good thing. But i dont know how successful you would be at getting custody unless you can prove that your ex is unfit (was she doing or selling the drugs, is the baby is danger?) Call your lawyer.

You must become an American citizen first - otherwise you will have deportation problems if you try to get custody.
Just report her to the local Children & Youth - and they will investigate. - have someone call from a payphone and say to them what you know to be true.
If C&Y finds that the children are in danger the children will be given to you - and don't mention that you are not a US citizen yet.

well if drugs are around your kids and you can prove that, it would probably be possible, but it is very hard to get sole legal custody

The only danger I can think of, for you, is that they will remove the child into foster care and not into your care. You will need to consult an immigration lawyer and a family law lawyer.
