am taking care of him so is it legal to do so?

Yes, it is possible, provided that he meet the 4 qualifying tests for a dependent. You can find them in the IRS Publication 501: Exemptions, Standard Deduction, and Filing Information, or Tax Topic 354: Dependents.

In general, to qualify he must be related to you (and he is), must not have earned at least $3300 in 2006 (social security retirement benefits do not count), must have lived with you for at least half the year (as your father, that probably doesn't apply) and you must have provided more than half of his upkeep for the year.

Possibly. If he has less than $3,300 in gross income (not including Social Security) and you provided more than half of his support you can claim him. Since he is your father, he does NOT need to live with you.

I would think that you could, but you really should ask the ones that make the final decision on that in the first place, the IRS.

I would trust what they told me far more than what you would get here from strangers.

You can clam him as your dependent, and you will probably get a little more back, as long as you are taking care of him.Yes it is legal.

I would think so since you are his caretaker ,but contact the IRS and they will let you know what you can do!! GOOD LUCK!!
