So a friend of mine's BROTHER (let's call him Hank)wrecked her car the day before he left for Russia. He was arrested, no license and he did not speak ANY english, and released on $1,000 bond, which she paid for (let's call her Susie). So Susie went to court on Hank's behalf yesterday hoping to get the case wiped clean or at least have NO warrant issued. She has already lost her $1,000 bond. The judge however doesn't care that Hank is back in Russia, is 18, and did no damage to anyone or anything but Susie's car. (We all thought that no warrant would be issued, because it would be more paperwork than necessary)

The judge has given Susie 30days to get Hank back into the US or to get a lawyer on his behalf. It is impossible to get Hank back here for another 6 months. and the lawyers have been quoting her upwards of $2,000 to defend him, which she can not afford (she could barely afford the bond). She is really upset and crying, she doesn't want her brother to never come back, help!

I did say that he was arrested because he spoke NO english at all. He had no license or english written ID. And also Hank is Susie's Brother, he is 18 years old

Hank was already scheduled to leave for Russia, and he got into the accident the day before he was scheduled to leave.

Unfortunately, the worst of what could happen to HER has happened: she lost the bond money she posted. Bond is supposed to help guarantee a person's appearance in court. Was he already scheduled to go to Russia before the wreck? Sounds to me like he fled the jurisdiction on purpose. Only an attorney can make an appearance for someone else in court, it is not unusual that the order for arrest was issued. What state did this happen in? Sounds like a misdemeanor charge, so if her brother had no prior record, he probably wouldn't go to jail even if he returned and was convicted. He ought to take care of his own business in court, I regret that your friend is upset, but she shouldn't be the one worrying, she did not make this mess. If this guy had the means to travel to Russia, he could have hired an attorney or paid his fines & costs & been done with this.

Hate to be the bearer of bad news, my friend, but "Susie" is in a bad spot. She put up the bond for him, now she's on the hook. When you put up a bond for someone, you are personally guaranteeing that the accused person will appear in court, and if he/she doesn't appear the court keeps the bond money you paid. The judge doesn't care where "Hank" is; all he cares about is "Hank" coming to court and answering for whatever crime he was charged with and arrested for.

The only thing I can recommend is that "Susie" call the court, explain the fact that "Hank" can't come back for six months and she's trying to do what she can but she can't afford the $2,000.00 retainer fee for a lawyer and ask if there is anything the court can do. The judge may appoint a public defender to handle the case free of charge. If that doesn't work, have "Susie" call your State Bar Association and explain the situation. They may be able to find someone who will represent her pro bono (at no charge). Good luck!

One can't help but KNOW there's more to this story than you're telling.

You don't get arrested for an accident unless there's more to this case. For instance, an arrest would occur in an accident if there was alcohol or illegal drugs involved...then there would be a "bond."

When "bond" is posted to get out of jail...what you're doing is promising the court you will appear on the date indicated at time of release and if one should fail to appear....lose the money paid for bond (bond forfeiture).

Because this person is the one responsible for his actions...only he can appear before the judge unless he's represented by an attorney.

Either find out who the court appointed attorney WOULD be and seek their help...or contact the District Attorney for further guidence.

You've certainly got a can of worms here but...

Drove without a license or insurance, presumably (since you need a license for that) and got into an accident, AND jumped bail.

Why should a court let him come back?

Why can't he come back for 6 months? The answer to that may be the answer. I think he can get a delayed court date for a good enough reason.

thats sounds pretty messed up. keep searching for lawyers their are some cheaper ones out there. but if he had to leave the country ,he really had no choice.
