My SUV was rear-ended by a tractor trailer on an interstate off ramp 3 months ago. I'm 34 & this was my 1st accident ever. My bumper only had $800 worth of damage. My 10-yr old daughter, 5-yr old son, and I went to the emergency room the next day because we had severe neck & back pain. We were diagnosed with muscle spasm. Two weeks later, my daughter & I started chiropractic care because our pain had not subsided. We went to the chiropractor for 2 months. My daughter has completely recovered and I only have mild pain in my neck when I turn it. How much should I ask for in my insurance settlement with the trucker's company? ( Oh yeah, I live in N.Carolina and our medical bill totaled $8,000)

Im not sure if North Carolina is a no fault state (aka your own insurance pays a portion of your injuries) but.. if its not.. and the at fault driver is responsible for all your medical bills.. then, a responsible amount would be for them to pay your medical bills (8000.00- which obviously would not go to you) and MAYBE another 1-2k for yourself. Please Please Please dont listen to the people on here who are gonan tell you that you will get 25k or something ridiculous. They obviously ahvent been in an accident..

Just as a heads up.. you will be getting alot of advice to get a lawyer too... what people dont realize is i see EVERY DAY people who run to a lawyer wind up with far less as there lawyer takes 30% of the settlement. Why dont you try to work with the insurance first before running to a lawyer and throwing them your money? People in this country are so sue-happy its ridiculous

You won't have the option to "ask" for any amount of money.....they will settle with you based on the % of permanent damage/loss you and your family members suffered... You'll probably be lucky to get anything more than your expenses covered. Maybe a couple hundred bucks..but don't hold your breath for a large settlement. It just won't happen.....I was rear ended by a grain truck full of grain that was doing 55 mph when he hit me..I was sitting still waiting to make a left turn....after 2 years of medical treatment, totalled my car....and months of lost wages...I only got $125,000. And, I had the best accident/injury attorney money could buy. That accident was in 11/2000 and I still suffer from neck pain and headaches from it, and have been told I will suffer the rest of my life. Sorry to be the bearer of bad news....but, be you should be thankful that you and your children are ok..and don't have any permanent injuries.....God Bless and take care!

First thing to do would be discuss this with your insurance agent, who can help you to get what is coming to you. At a minimum you should be made whole, get back any out of pocket expenses for medical, plus the value of the damage to your vehicle. If you missed any days of work, that would also be compensatible You may or may not be able to claim pain and suffering, but discuss it with your agent first.

I don't think you can request any more than what the other vehicle was insured for. Request the amount of repairs and your out of pocket medical expenses, and if you require additional medical treatment, possibly 2-4 months of office visits. If you expect any more, you'll have to prepare for a lawsuit able to pay for an attorney who will accept your case.

Research paper work. If you missed work due to injuries, you can claim for that time as well.
Trips to and from a medical facility can be claimed (wear and fuel cost).
Anything directly related to injuries sustained and damage can be claimed.
I find that working with a competent claims person and staying on top of the issue helps imensely.

Forget your insurance agent, hire a lawyer.

Him/her give you advice on how to move forward. If you choose to use a lawyer, get your lawyer to deal with both your insurance agent and the driver of the Semi's agent or lawyer.
