I got a friend that is getting married and she wants to know if she can stay in the US.

Absolutely not...there is a lot of paperwork to do...and a lot of proofs have to be given....

If a non-citizen marries a US citizen, they do not automatically become a citizen. They would still have to apply for citizenship and go thru the process. If the person is not here legally, it is a little harder.

It used to be that a person who was not here legally could marry a US citizen and then apply for a "green card" . I believe that law has changed.

You should contact someone who knows immigration law --many lawyers specialize in that.

if her future husband s an american citizen yes she can get a green card but not become a citizen she has to wait 3 years actually is 2 1/2 but to be reazonable wil be 3 years when she cam apply for citizenship just if she is marry to a citizen here in the US...

No.... My hubby and I just got married in December of 27, He still have to file for his residence. Though he falls into the D.O.R.A act because he is on Visa here. We are in the process at this time filling out the papers and I will tell ya it has been a headache from the get go on getting these papers done. These est. times they say is not right.... One form it took me 2 hours.... I have a headache with all this.
I wish someone could sit and explain everything to me on these forms..... If anyone as been doing these forms to file please email me... strawberrywhip34@yahoo.com..... thank you

No, citizenship acquired by simply marrying a foreigner is something quite rare in the world today. Whoever the alien is, they will have to apply for citizenship just like any other person.

I think you have to stay married for 3 years. There are some conditions, so people don't abuse the system by just doing a quick marry-get citizenship-get divorced.

no, she has to apply. On the other hand, if she has a child that child becomes an automatic citizen at birth (go figure).

they do not automatically become citizens. My husband is in the same situation and still has to appy for citizenship.

She needs to be petitioned to stay in america with I-130 and I485 forms.

No, it's a beginning but the process is still long and complicated.
Personally, I think it's a good idea since there are so many
marriages of convenience, and these are illegal....
