I dont know where you are from, so I can only talk for the Dutch situation. In the Netherlands, children can / may chose where they want to live at the age of 12, yet most parents chose for co-parenting partnership.
I think you should make an apointment with a lawyer who deals with family related stuff, as he / she will know what the rules and laws are. MOst first consultations are free, but ask before hand. And even if it costs money: you will get the right information, and know where you and your kids stand.

If you are in the UK the courts will take into account what each child wants to do. Your two eldest are old enough to make their own minds up where they wish to live. Your 11 year old could possibly be old enough but may come down to how responsible/mature they are. However the courts dont like to split children up unless necessary so you would have a good case to have all three home again. Seek legal advice through CAB then take it from there. Good luck

it doesn't sound as if he is ill treating them, he is a working single parent. Why don't you work together to share the responsibility of your children instead of trying to take them away from their dad?
Work something out between you for the sake of the kids even if you two hate each other it's the kids that matter. If your at home all day pick them up from school and take them to yours, give them dinner and help them with their homework. The guy is probably trying his best to feed, clothe and keep a roof over there heads all by himself and this makes it hard for him to be there for them as much as he needs to be. Help the man out, you made them together so look after them together.
I can't help feeling if it was a man asking this question about about his ex and the kids the answers would be very very different.

It depends on what state the children are in, number one. Number two the court would have to be petitioned on behalf of the chldren and the children would have to talk to the judge as to why they would want to live with the other parent. EVERYTHING is taken into consideration and then the judge rules on what is in the best interest of the child. If both parents are agreeable to it however there isn't need to get the court involved other than changing the child support order...and mom IS paying child support right?

It should be decided in court. You will have to prove to the court that their father does'nt take proper care of them. Normally in case of a divorce the judge give the custody of the children o the mother(provided she can take care of them).If what u have told is true,I don't think u will have any problem getting custody of the chidren. It would help a ton if the children tell the court that the want to be with their mother.

Depends on the state. You can call the courthouse and they can probably tell you or you can get a lawyer. If you haven't the money for a lawyer you can contact the Legal Aid Society in your state and they will help you; they have web sites for every state.

sounds like u have a pretty good argument if u decide to go to court
since they're so young, it's really not their decision.it's more of the parents, but we always must have the children in their best interest. so yeah...
