Any guy that would continue when he realizes she is crying and saying no, that is rape, even if she isn't pushing you away.

actually yes she CAN claim rape, for the simple reason that she's saying "NO", and you keep at it.
If she doesn't try and push you away, it's not because she likes it, it's because she's AFRAID and SCARED.
You should really respect her decision if she's telling you "NO", and you don't listen to her.
There are MANY excuses for a guy raping a girl, and NONE of these excuses are acceptable.

everyone's answer is too short. This is the deal. Unfortunately, she can claim rape even though all she did was say no and cry. She didn't try to push you off or fight it because she did want to screw. Maybe she wasn't sure but she let it happen. You shouldn't have kept going if she said no and cried but hey, when you got a bone, what are you gonna do, right? Just try to talk to her about it so that she feels ok and doesn't want to get you in trouble.

A man should always err on the side of caution. If she is saying no, you'd better take her seriously. The could report that you raped her and that she was just to scared to physically fight back. Please respect a woman's words and stop when in doubt.

no physical resistence is necessary, the part of rape law was puropsely dropped from most states criminal codes because often the woman would no resist to avoid getting hurt
