a restricted license allows you to go to and from work but how do you prove it to a cop if you get pulled over? in other words how do they know if you work where you say you do and if you belong in the area you are driving in? anyone in from California DMV or law enforcement would be a great help to me here..........thanks....

That is a good question. In California, I don't think the DMV puts specific hours when you can drive or not. It says that the restriction is for driving to/from/during/in the scope of your job, and to/from the DUI classes you need to attend.

For alot of professions (including mine), I don't work a strict 9-5. Often times, I don't leave the office until after 9pm, and often times come into work on the weekends. Also, I travel alot through Southern California.

What I am curious about (and maybe someone can answer this), if you have a restricted license, and let's say you are just stopped at a red light and a police officer happens to be stopped right behind your car, and they randomly run your plates, do they have probable cause to pull you over just to check and see if you are driving for work purposes? In other words, if you haven't committed a traffic violation or anything. I have heard that some states do that, and other states require that the officer has to get a physical description off his computer and then verify that the person driving matches the description BEFORE they have cause to pull them over.

12813. (a) The department may, upon issuing a driver's license or after issuance whenever good cause appears, impose restrictions suitable to the licensee's driving ability with respect to the type of, or special mechanical control devices required on, a motor vehicle which the licensee may operate or impose other restrictions applicable to the licensee that the department may determine to be appropriate to assure the safe operation of a motor vehicle by the licensee.
(b) The department may issue either a special restricted license or may set forth the restrictions upon the usual license form.

(c) The authority of the department to issue restricted licenses under this section is subject to Sections 12812, 13352, and 13352.5.

Amended Sec. 5, Ch. 756, Stats. 1998. Effective January 1, 1999. Operative July 1, 1999.

Law enforcement officers have to use their good judgement and common sense to determine if you are actually in violation of a restricted license.

If you're visiting Disney Land while your residence is in San Francisco....you're in trouble!

There is usually a time on the slip that says from the hours of sunrise to sundown, if you are a construction worker etc. Or the hours 8-5 except if you have children and are taking them to a medical place; hosp., drs. appt, etc

where you are allowed to drive is a matter of recordin my state. It is stated when you are given a restricted and the information is given when they radio your operators number in to dispatch.

Probably they would look at the address on your license (to see where you live) and then ask where you work and what freeway or roads you take to get there.

they have a computer that runs the D.L number to see who has what type of license.
