new name and starting paying checks with NO taxes being taking out. Now that its tax time they are telling me I have to fill out a 10-99?, and pay taxes back? Wasnt I supposed to sign something first? Is this legal for them to do this after the fact?

Yes, they absolutely should have told you ahead of time. But didn't you notice that there weren't any taxes being taken out? If you weren't paying them all along, then you are responsible for them now. Sorry.

It would be illegal for them NOT to give you a 1099 now, if they've been paying you. If you feel that you should be classified as an employee (taxes taken out, get a W-2 at the end of the year) rather than a contract worker (no taxes taken out, you're responsible for paying your own - you get a 1099 instead of a W-2) you can request a determination from the IRS. In any case, the income taxes, and at least the employee half of the social security and medicare taxes, are your responsibility, so if you haven't paid them up to now, you'll owe them when you file your return.
