Some people are top-floor people and some are bottom-floor people. If hearing noise from above bothers you, ask yourself if having a quieter place is more important to you than having to be conscious of the noise you make yourself; that'll be a big part of the decision.
Children upstairs is always a tough one. It's generally not legal for a landlord to require residents with children to live on the ground floor, and making a young child stop running and jumping for more than a few minutes at a time can be next to impossible. While they might be able to evict them if the noise is too outrageous, it's hard to do and takes a very long time, and meantime you'll have made a real enemy of that neighbor -- and done them a pretty dirty turn besides.
Generally, it may be easier on you to take the upper-floor place. Only you can decide that, of course. Which is likely to bother you more: moving again or putting up with noise that your landlord is virtually powerless to stop? The top floor will almost certainly be quieter, and if it isn't any noise problems will likely be of the sort your landlord WILL be able to address effectively.
As to the middle floor: though it's often the cheapest choice, both on rent and energy costs, the reason it's usually the chepest rent is that it combines the negatives of both ground and top-floor apartments. Only go for it if the apartment has some feature that you really, really want.

These are the types of things you will have to deal with when you live in an apartment complex. Moving to the top floor might take care of the noisy child issue but there's no telling what kind of noise you will have to put up with when you're three flights up. What if your new neighbors are a young couple that have loud sex all hours of the night? Or what if your new neighbor is a chain smoker that coughs constantly? My friend lives in an apartment and is kept awake most of the night by things like coughing and people having sex, which are two things a landlord can do nothing about. A small child shouldn't be running around all hours of the night, so try talking to the people who live above you and see if you can work out some sort of compromise with them. As far as the pitter patter of feet during the day, there's really nothing you can do about that because kids have a lot of energy. I don't blame you for not wanting to move everything all over again. Give it a few weeks, maybe you'll learn to ignore the noise or drown it out somehow. Good luck.

I live on the second floor of my apartment complex. The second floor is cheaper, at least here, since there are people both above and below. And the heating bills are cheaper since we are surrounded by other apartments. I'm in the farthest one to the street though, so I don't get sound from anyone next us. I would suggest talking to your upstairs neighbor again. Maybe just ask if they could try to keep it down only after a certain time, like 9 or 10. If the sound is too horrible, I would move up to the 3rd floor. Yea, the move is gonna suck going up three flights of stairs, but it will be worth it when you can sleep in peace.

I live on the second floor of my apartment building. There is only two floors and I really like it. I recently stayed with a friend who lived on the bottom of three floors. Her neighbors to the top walked around all the time and the floor squeaked. Almost seemed like they were doing it on purpose. After staying there it made me happy to live on the top floor. My neighbors are really quiet too. I think I just got lucky. But I would move to the top floor if I were you.

Living on the second or third floor is safer too! You might still hear noises...at least they're not above your head! If B/f is wanting to so badly then he must be wanting to enough to move all your stuff himself? Do you what you think is going to be best for you personally!

Stop being tight asses and realize that its just a kid running and he's not doing it on purpose to bother you HE'S BEING A KID, but in this case i believe you and your b/f are the kids.
