I signed the aknowledgement of paternity and then was told I wasn't the father, but the mother is taking me to court for child support and I petitioned for the aknowledgement of paternity to be rescinded. Our court date is regarding both petitions I believe.

I was helping out untill she decided she wanted more and then told me I would be stuck paying support becuase I singed the aknowledgement of paternity which I have now petitioned to be rescinded but my petition and her petition for support is on the same day.

that really doesn't make any sense because if your not the father why are she trying to make you pay child support trust if you came out to not be the father I don't think you have anything to worry about in court Good Luck to Ya and hopefully my answer is on the right track also if your have not received the results yet like i said why would they make you pay child support know one knows who the father is

No, you do not need to pay child support until paternity is proved by DNA testing. But, if paternity is proven, then you may have to pay backed child support for the time between tests. Child support laws vary by state. You are better off checking with a lawyer or your local child support office on the back pay thing.

If you do pay child support during this time and the test comes back negative, you will not be able to recover the money paid out.

To be safe, you may want to keep paying it, if it turns out your not the father you can sue her to get the money back.

At the very least you should probably put the money into an account so that it's there if the child is yours and you owe all the back support.

I don't know the legal answer, but I think you should definitely insist on DNA paternity testing. Sounds like she doesn't know who the father is.

it doesn't matter want we say or anyone else it only matters what the judge says. who told you that you wasn't the father?? you might be able to use that info in court but don't bet on it. the dna will solve all problems. don't pay until then.
