we have had the dog for 1.5 years - she got loose one day recently and the people who used to have her nabbed her and won't give her back to us. My daughter is devistated! we each have the same ownership paperwork since they gave me copies with her 1.5 year ago. - so the police can't help - only the courts and that's impossibly expensive. we don't know what to do

the dog had got out of my yard while in someone else's care (while I was at work and the kids at school). I received a phone call from the woman who had given her to me. I went to her house, but her husband refused to give me the dog back (the woman wouldn't go against her husband's wishes). The police wouldn't help since it is considered by them to be a civil suit.
She called me later and suggested that if our daughters could "trust each other" then maybe we could share the dog. And that we should "keep the men out of it". At that moment, I have to admit that I was so anxious to get the dog back for my daughter that I started to accepted the idea. However, she asked me to "let the dust settle" (which I took to mean let her husband cool off), and she was supposed to call to arrange a meeting somewhere, but that has been nearly 3 months. I really don't know wht's the best to do. I have many other things worrying me now also. I need to be sure that this won't be a pandora's box for me.

If the police don't help and you don't want to go to court (for financial or other reasons) there is not much you can do. While you don't want to send the message to your daughter that dogs are "replaceable", after all each is unique and special. You could explain to her that this individual is keeping the dog (right or wrong), present however you think will be best for your daughter and that you and her (your daughter) will select a different dog to be hers. Remember that there are plenty of excellent dogs in shelters and at your local SPCA.

you did not explain what started the problem. Why did they grab the dog? I think there is more to this story. As my baby sits on my chest so I can't see what i am typeing. Ok back. you have duplicate papers so that shows that they did give her to you. If you can produce vet records that is proof. Small claims court is very inexpensive. maybe 60.00. The big question is will you win the case? Because you left something out of this question. You didn't say you went to these people and asked for the dog back. why?

Well there are lawyers that will advise or take on a probono case. I think your best bet would be to calm down and try to work thing out. I saw a case with a horse like this and a year latter they are still fighting in court over whom it belongs to. The fact that the dog got out may make things worse they people that had her before may believe they are doing what is in the dog's best interest. So talking in a calm manner and assuring them it will not happen again is a good start. Sorry for your trouble and I hope it works out for the best for everyone.

It's a civil issue, only way to resolve it is to go to court (if you want the dog back). If you do go to court, make sure you have letters from neighbors / friends stating the dog has been with you the past 1.5 yrs. Also get together any receipts you may have for grooming, food, vet bills etc, to show proof.

Let them keep their old dog-if it has been 3 months now then your daughter has probably mended her broken heart a bit by now- Tell her that you & her are going to let her pick out her very own special dog who will love you and the rest of the family now & forever! And then go to your local shelter and stroll through all the poor pups and dogs NEEDING A HOME (unlike your former dog who has two homes sort of) cause if they don't get adopted they will more than likely be put to sleep!And they will help you choose the perfect one for your lifestyles! If something is too expensive (figuratively speaking) for your dog, then you don't deserve to have one. Yes, I'm blunt. Now if you literally can't afford to do a civil lawsuit, then I'd understand. Otherwise, take the case to court, bring all the proof you can find, and hope for the best. And if not for yourself, do it for your daughter.

because of the ownership issue(papers) i don't think there much of a good chance of getting the dog back even in small claims court.( eg..who was the original owner?) it may be less costly to get another pup.
you can use this situation to explain to your daughter the morals of right and wrong.( it's wrong to take something back after giving it away)

whom is on the onwership papers if its you well i would take her to small claims court and let them tell her hard head husband to give the dog back and if you are not on the papers then i dont think small claims can help you and if this is the case i would go get your daughter and new puppy and just explain to her why you had to get another puppy

You may have to get a different dog. Sorry that your daughter has to go thru such a hard time. Some people are just cruel.

Ya know what....Go to the pound and let your daughter pick out her own special "pound puppy" and move on. This will do nothing but emotionally aggrevate you and your family. Life is to short, and God has a special gift waiting for you to find. Go look!
