I'm a senior in high school and today i was leaving school with my friend and where I'm park there is another car that pulls in in front of me but facing towards my car. The car was parked right on top of my car and i had damage to my car. I pulled my car back a bit and looked at it. It's not "that much damage" but the paint is chipped off the front of my car and there is a dent and a scratch. The other girls car was more damaged. She had more paint taken off from her car and a bigger dent on her car. It must have been this morning. I got to school early in the morning and her car wasn't there yet. Any way i drove my friend home and decided to drive back to school and tell my principal what happened considering i had her parking spot number...well when i got there the OTHER GIRL was there and told the principal i hit HER CAR and she wants me to pay for her damages towards HER CAR!! I DID NOT HIT HER CAR but my principal said i have no proof that i didn't hit her car!! WHAT SHOULD I DO?

You shouldve reported it before u left the parking lot, right when u saw it. You can argue this , perhaps another witness that you were there before her.

You need to report the incident to the school, your parents, and to the police, because it will affect your insurance. (It counts as a "motor vehicle accident" even if you weren't in the car when it happened.)
Grab a camera and take pictures of the damage to your car. Then write up a formal explanation of what happened, in chonological order, including as many details as possible (the time you parked, the time you noticed the damage, angle at which the other car was parked on top of yours, etc). have your parents review this report before it is submitted. The school and the insurance companies will review both statements and make their judgements on who is at fault, or if fault cannot be determined (in which case both parties are usually penalized).

Also, ask around the school for witnesses - someone must have seen the accident, or must have seen you arrive and can attest to the fact that you did not hit her car.

In this situation, your parents are your best advocates, and witnesses are your best proof. Good luck.

I honestly don't know how she would have had damage to her car based on your description-you said she parked on top of your car. Either you are not telling the truth or her damage happened at an earlier time and she being a con artist trying to get it fixed Look at her damage, is there evidence of rust, where the paint chipped off. If so-the damage is old.

does your school have cameras in parking lot? If so ask if you can view the tapes for that day.

This is a problem to be solved by both insurance companies. The other girl's car insurance, and yours should settle. However I must warn you about the following: If you parked in the other girls parking area, the principal might have already given a verdict. So far as I understand, the Principal's opinion is of no interest to the insurance companies. You should immediately call your Car's insurance representative and tell them what happened. Also you might have to make a declaration to your State Police's trooper!!! Goo Luck!

you should have said something right away it is against the law to leave the scene of an accident. But there is no proof that you did hit her car either. The best thing you can do is take pictures of both cars. Next get a lawyer and sue her the lawyer will be able to help reinact the accident and prove to the insurance company(which you also need to inform) that you did not cause the accident.

First realize she has no proof either. Did you see anyone this morning who can verify the time you got to school? If someone can vouch for you, you can at least say how it would have been impossible for you to hit her car considering hers' wasn't there yet.
If she is going to be dishonest, you may want to call your insurance or your parents call asap and report a hit and run. Then you'll at least have that on record, and if you really can prove you were there first and she parked right by you, it makes her look more guilty.
You may wind up having to fight it so move quick on trying to prove you were already in the school when it happened.

This is one of those cases where proof is only there with witnesses. Did someone ride to school with you and know that no one was there. you really should have reported the incident immediately. The only other way to prove it is if the other girl checked into school or there are cameras. you may very well wind up in small claims court but chances are since there is no solid proof either way you both wind up paying for your own damages.

What you should have done in the first place was to call the police so that they could take pictures of the damages. You need to file a report, and get a hold of your insurance company now it is your word against hers.

Tell the principal that she has no proof that you hit her car and what really happened. Take your friend with you.

You don't need to go through your school principle, you need to get a police report! You should have done that as soon as it happened and you shouldn't have mopved your car, you should have left it the way it was so you could better tell who's fault it was, just for future reference.
