My doctor prescribed me ritalin, and I went to the pharmacy to get it filled but my insurance denied it saying i was too old and said i had to get a prior authorization form completed by my doctor. So i paid for the meds anyways assuming the doc would fill out the form. Anyways the meds made me not sleep for 8 days then I had to schedule another doc appointment. She then gave me Strattera samples and told me to stay off the ritalin. I told her about the prior authorization form and she said have the form faxed to her and she would take care of it. Now her secretary is telling me that the doc wont fill out the form because ive already been given Strattera! What are my rights here? Does my doctor have to fill out the form? I want to be reimbursed for the Ritalin.

I work in a pharmacy and I see this all the time. what has probably happened is that the doctor doesn't realize or forgot that you've already picked up/paid for the meds and just need a reimbursement. I would call the pharmacy, get the number that the doctor needs to call, take both prescriptions(with receipts) to the doctors office and show/explain the problem TO THE DOCTOR in person. that wasn't a nurse that you spoke with, she was an assistant. I usually have a lot of trouble with assistants because they think they know more than they actually do. It will be difficult now (after that long) but you probably can get it worked out. If you can't there's nothing else you can do. It's in the hands of the Dr. and insurance company.
When you choose to pay cash price in hopes for a refund you pretty much are taking a risk. The Dr. doesn't have to fill those papers, many just find it easier to change the prescription rather than stay on the phone with insurance companies all day. If anything blame your insurance company for trying to cut corners at the risk of your health.

Please consider why the pain is so bad. It is caused by a gallstone that is stuck in the common duct, and can't go through the liver and on thru the system. You may have one stone or many. When the stone gets stuck and cannot go forward or backward, it can cause emergency surgery. If you take care of it now, it is minor laparoscopic surgery and requires only 5 small incisions. If course the whole gallbladder must come out just to get the stone out. #1 See a doctor and get a sonogram. It will tell the size, where it is and if a surgery is indicated. #2 Surgery is scheduled and is an outpatient affair. #3 Most all insurances pay for it, even Medicaid. I waited 3 years due to fear of the surgery. I was in periodic pain so bad that I cried all day. The whole thing was cured in a couple hours. GET IT DONE!

In a nutshell.........you're out of luck. The doctor cannot be compelled to complete prior authorization forms. Even if they did fill out the form it is no guarantee that your insurance would pay for them.
