Yesterday at school me and a girl backed our trucks into each other. We were both parked behind each other in the school parking lot and backed out at the same time. She ended up pullin out faster than me and i hit the side of her truck with my bumper. It put a tiny dent into the side of her truck. She wants me to pay for her truck getting fixed, since nothing happened to my truck. I was just wondering what the insurance company would do.. cuz it was both our faults.. so would my insurance pay or would hers for her truck?

Thank you for your help!

If you both pulled out at the same time you would both be considered at fault in this type of accident. If you DID have damage you'd each be responsible for half of each other's damage. So if she had $1000 damage and you had $500 she's be responsible for $500 of the damage to her car and $250 of the damage to yours, and so would you. (Not that insurance companies won't try to push that to 75%/25%, but this is in general).

Since you did hit the side of her car, though, the insurance company will likely say you are more at fault than she is.

Since there is no damage to your vehicle, you would be responsible for (at least) 50% of the damage to her vehicle. Because you are young and rates are so high, I'd find out how much the damage to her car is and begin by offering to pay for half of that. I'd go up to 75%, as long as it was financially feasible.

And remember, you won't get anywhere by being nasty. Keep it nice.

Amazing the people that don't know but answer anyway. School parking lot is private property. As such there is a very good chance the police wouldn't come out to do a report in the first place.

Sorry, if you hit the SIDE of her truck with your bumper, she was in the lane and you were backing, so it IS your fault. If you had hit back to back you might be able to argue 50/50, but not the way you described it.

Have her get an estimate as to repairing her damage. "Tiny" dents can be very expensive, as you are about to find out. If you can pay it out of pocket, do so. If not, report it. Yes, your insurance will pay. Yes, there is a good chance your rates will increase as a result.

It depends on the laws of the state you are in. In some states, you'll be held fully responsible, in some, a proportion of each loss will be assigned to each of you, and in some, the loss would go 50/50 with each of you paying the damages for your own vehicles.

You'll have to call your agent to find out which applies to you. And you'll probably want to put a claim in anyway.

You're not going to get the police to come out and give you a report - mostly that doesn't happen any more, unless there's bodily injury (like, the need for an ambulance) or one of the vehicles isn't drivable.

I thought an insurance company would NEED a police report in order to process a claim.

Find out if this is the case in the State where you live.

Most people have a deductible of $500.00 or $1000.00 and the kind of damage you are describing doesn't seem to require much more than THAT to fix it.

Bypass the insurance and just pay for the b*tch's repair. Women always win anyway.

Insurance would probably make you pay for 1/2. Tell her to get a quote and you will pay half. If you go through insurance for something small like that, both of your rates will increase. I have been in 2 minor accidents and never went through insurance.

It is private property and in a parking lot. Its VERY hard to show fault in a parking lot! I have been through it twice and the people that hit me in both instances did not pay for the damage. If there is damage done in a parking lot its pretty much a no fault zone where you pay for your own damage. You most likely won't have to pay for the damage done to her car.

you should of filed an accident report, if someone was at fault it would say in there and you would be more likely to get a claim paid. You should turn it over to insurance. talk to your agent and see what he says.
