I received a QDRO in my divorce as a settlement. Why am I being charged the early withdrawal penalty?

Is there any exception that I can take for the tax penalty? Professional advice needed please.

I guess I should've had him withdraw the money so he could pay the taxes. That would also explain why that is how I received my settlement, which is all I got. He got everything else.
