I do currently pay my child support, and have no issue in doing so, I am just wondering, due to the fact they are trying to modify the amount, since my LES shows deployment pay. I just got the email from the lawyer about it, and being stationed in Germany, I can't get to JAG right now, its 9pm, I'm just wondering what I can find out in the mean time. Thanks for those that have given real answers.

You need to speak to base legal about this. A barracks mate of mine had a huge chunk of his pay taken out for child support, but there were other circumstances there.
You get free legal advice in the military. Just make sure it comes from a real lawyer and not a barracks lawyer.

The pain in the neck about the military is their ability to quickly and efficiently deduct funds automatically from your paycheck for legal issues... try to avoid putting yourself in any situation where your pay gets reduced this way. PAY YOUR CHILD SUPPORT!!!! It's funny how everything else the military does is hurry up and wait, except them diverting part of your pay.

They can take any amount from your total income they feel is expeditious. Being in the military does not exempt you from your responsibility as a parent. The amount will be set up by the courts in your state and the military will deduct what the court tells them they must.

When child support amounts are set, they are set using your TOTAL income, not just your base pay - just like it would be in civilian life.

They can only take a percentage based on your base pay. None of the extra pay can be included. The percent is based on a court order and will vary by state. Being in the military however means they will make sure you pay.

Ask a lawyer in the JAG. They get paid to answer your questions. Don't trust any of the answers you get on here.

Whatever is set out by your state's guidelines. They only take out the amount you are supposed to pay,or if you're behind, then they take that out.

If your CO wants to be real nasty and does not like you they can turn your entire paycheck over to your spouse. See the AG. Or go to the Chaplain, he or she can assist you in your plight.
