When you fill out your 1040, you file whatever you are at the end of the year, I believe. You can claim whatever you want the rest of the year, but the 1040 HAS to be what you truly are.

You are confusing "filing" with the report the person gave to their employer to set up their withholding amounts. That's a Form W-4 and you can call yourself married, single or whatever. "Filing" is what you do once per year, normally between January 1 and April 15. In your tax return that you "file" you must give your legal marital status. If you are married even on 12/31/0x you are considered married for the whole year and you can then choose Married-Joint or Married-Separate. Both spouses must file the same status.

if someone was married on 12/31/2006 they filed married for the entire year...generally joint is the best way financially to go...but single is no longer an option because they were married by the end of the year so it counts for the whole year...same would be true of divorce

Congratulation!!! But regardless of what date or month during 2006 you are married. There is a question that asked "were you LEGALLY MARRIED before 12/31/2006. Depending on what you answer that will be your filing statues.

Marital status for filing taxes depends on your status on the last day of the year, so he will file as married.

DEFINITLY MARRIED! You're going to get a nice return this year! Even if you were married on Dec 31st you'd be able to file married. You may want to change your W4 withholdings to indicate Married so they withhold less tax from your paychecks for next year.
