Actual mailing date could result in fines IF you don't receive the W2s on or before February 15th. If you do, there's no case or reason to file a complaint. Especially if you want to continue working there.

$50.00 per W2 (max $100,000) sent late. Plus $100.00 per W2 (no maximum) for willful disregard of the rules.

The penalties are waived if the employer can show good cause for late mailing. Employers affected by the recent ice storms in the Midwest would be a possible example of good cause.
