My refund is being held for review, along with many others. I'm trying to be proactive because I have a feeling that my refund will be delayed, especially if they go over it with a fine tooth comb. I claim my sister, we are 20 years apart, and her father owes the IRS like 30,000.

I don't have a birth certificate or a social security card for her. I'm in the process of trying to get both, they have always gave me such a hard time. The only thing that I do have is a vague court order that I have permanent custody as of August 2002. She was placed with me thru the state due to abuse and neglect. I claimed her as a foster child for 2000, 2001 and sister for the other years. Actually I ammended 2000 and 2001 because I did not realize that I could claim her. I recieved an EIC and interest for those years. I won the lottery in 2002, so I didn't get an EIC, but did for 03,04,05.

If they need more information, is it only for this year??

In response to one of my answers....She is 12 years old and she does have a social security number, I just don't have a card.

If they need more information they will contact you in writing, there is a delay to more than 72,000 returns in regards to the EIC, so be patient, the delay is only 2 to 4 weeks, if there is no issue with your return, it will be sent out upon completion of processing.
If you don't have it in the time frame you were quoted call the IRS at 1-800-829-1040

For the EIC with a qualifying child, the person must pass relationship, age and residency tests. A sister meets the relationship test. Age for claiming for EIC is under 19, or under 24 and a full-time student for some part of at least five months of the year, or permanently and totally disabled at any time during 2006. For residency, must have lived with you in the U.S. for more than half of 2006. You don't mention her age, but sounds like you are fine on the other two, so if she meets the age test also, you are probably OK.

How have you been claiming her all this time without a social security number? Does she have one, and you just don't have the card, or does she actually not have one? Not having that could hold things up for awhile for you, but if she's a citizen or legal resident, you might be able to get this worked out. But you might end up having a conversation with someone from the IRS over the missing social security number if it's not just that you don't have the card, she really doesn't have one. That doesn't mean that you are doing anything wrong, just that it's an unusual situation and the IRS has to figure it out.

They'll resolve this year first. If for some reason it's disallowed, then they could go back to earlier years, although it doesn't mean that they will.

I wouldn't get too worried about this since the IRS is screening every return this year that is claiming the EIC. They are not going to be searching court records to verify custody issues. You should, however get a copy of her SS card if you have legal custody. Tax pros are not allowed to put her on your return if you don't have that card. As long as you can legally claim her and no one else has, there shouldn't be problem other than the delayed refund while they work out the bugs of the new requirements and late law changes.

the EIC laws have changed for this year unlike previous years, there will be a delay becuase of it.
