Financial Management Services is the governing agency that issues the garnishments of wages and refunds. State and Federal agencys, Child support Enforcement, State Dept Of Revenue, report the debt to FMS, who in turn notifies the employers of the garnishment, and also directs the Internal Revenue Service to offset any Federal Income Tax refund.

It's not a garnishment (that requires a court order) but the effect is the same. Tax refunds can be attached for debts to the Federal government, unpaid student loans, unpaid state taxes, and unpaid child support. Confiscations are handled by Financial Management Services, an arm of the US Treasure Department.

ANY liens against your taxes must be filed with the IRS. No lien, no garnish. If it's state then I'm pretty sure it's the same for whichever state agency ios responsible. Don't have state taxes here so not positive on that part.

In Texas....Attorney General, for back or unpaid child support. The IRS, for unpaid back taxes. And some judgments.
To keep this from happening, you need to be more diligent in paying LESS of your taxes during the year, to minimize your refund. It sounds nice, you know, to get $2,000 back in a lump sum, but not at the expense of it being garnered. This will require you to be strict with yourself and put the extra money aside in a savings arena to still get the once a year lump sum. Are you strong enough? smiling.
