What crimes do you have to commit to be placed on the sex offenders data base. No obvious ones please.

I have found out that a family friend has been on the sex offender list. Though i am aware no to belive hear say. Even so i dont want to think the worst. If it is true how will I tell my family and this person i know.

Well, technically it depends on what state you reside in. The basic charges in most states that require you to register as a sex offender are:
Rape
Criminal Deviate Conduct
Child Molesting
Child Exploitation
Vicarious Sexual Gratification
Child Solicitation
Child Seduction Sexual Misconduct with a Minor as a Class A, B, or C felony
Incest
Sexual Battery
Kidnapping, if the victim is less than 18
Criminal Confinement, if the victim is less than 18
Possession of Child Pornography if the person has a prior unrelated conviction for Possession of Child Pornography

As long as your partner is of legal age and is a willing participant, you shouldn't have any problems.

If you are unlucky enough to be caught having sex in public then you will be arrested for the offence of Public Lewdness or maybe Gross Indecency.
If it's a first offence between consenting adults then all that will happen is a slap on the wrist (Verbal or Written Caution).
Multiple offences will incurr an appearance at Magistrates Court and a fine.
You would not be put on the Sex Offenders list. People who commit sexual crimes are put on that list eg Rape, Paedophillia, bestality etc.

Consensual public sex between two adults of the opposite sex usually won't qualify you for the sex offender's list lol. However if it between two consenting adults of the same sex it might cause some probs depending on the laws of that state...etc.
The sex offender list is made up of people convicted of sex crimes. Some of the previous answers list those crimes.
Let him know you are aware of his placement on the list. I would be interested in hearing his excuse.

why on earth do you need to have sex in public. If it is for the excitement then I would suggest you make your love making more exciting. Another thing is consideration for other people. Surely there must of been times in the past when you have felt that others did not consider you enough. Do you have to be the same as them. I personally think you are being selfish by not considering others. The world does not revolve around you. We all have to share this planet and the ability to get along with everyone on it

About 5 years ago two people where charged after being arrested for having sex in Public at an airport car park whilst being filmed for a porn video.

They where charged and taken to court, and fined, but I don't think they had to sign on the sex offenders register. Persistent offenders, (like doggers) are prosecuted if they keep on getting caught.

Your chances of getting the harshest punishment is directly related to how many times it's happened and who you are involved with. Minors would be a go to jail do not pass go. End up on the list. Homosexual acts would also be a major one you'd likely end up getting publicized with possibility of getting on the list - even if it was a consensual thing. There is a grey area in deciding if the act you were caught in poses a risk to the society you live in and will be judged according to the unique belief system prevelant in your area.

If he was involved with anyone under 18....and got in trouble (the other person could have LIED and the 'offender' would still be an offender).

Depends on the public place probably as well. If they were say at a daycare or a school - then I could almost see it.

Yes, you can be placed on the sex offenders list for having sex in public. This is concidered indecent exposure. Also, if you want to check on your friend to see if he is on the sex offender's list, go to the SLED website and click on sex offenders.

I believe it has to be rape or sex with a minor to get on the Sex Offender listings. Or possession of kiddie porn.

Sex between two consenting adults in public? You shouldnt be considered a sex offender, but it would depend on the laws in your state and how zealous the DA wants to be.

If they are on a sex offenders database it isn't hearsay, it means they have been convicted of a sex related charge:

sexual assault
sexual interference on person under 14
indecent exposure to person under 14
invitation to sexual touching person under 14

There may be more (Canada) but I can't think of them right now, either way if the person is on the list, it isn't good.
