Ok here is my question, now is this true or not I don't know that is why I am asking, ok if you marry a partner who is an illegal immigrant and you are a US citizen do you have to live with your partner for a year? and if you do is it true that a social worker from immigration comes by to check if your still living with your partner or what not to see that you didn't do it for money? so basically my question is does a social worker from immigration come by to check up to see if you two are really living together or not? and is it true if you have to live with your partner for a year so that your partner can get their papers as a US Citizen or resident alien?

they are suppose to... but they only do one interview with the couple ..the couple shows all the proof of being together...they ask them a couple of questions and after that immigration makes a decision...they give you a temporary immigration card for 5 years and if you prove that you have been with the same person they will supply you with permanent card......i know this because my half-sister went trough this process...

If he/she is an illegal alien ( entered the country without inspection), he/she cannot become a permanent resident or eventually a citizen of the USA unless the government gives amnesty ( sit and wait for it). NO MATTER who he/she marries. Marriage to a citizen does not guarantee a residency and he/she will continue being an illegal alien, once again, UNLESS the government provides amnesty to illegals.

If the person entered the country with an inspection and then overstayed and became illegal, I think there is a chance that they can gain residency, they will have to pay fines and explain why they overstayed.

So, for an person who entered without inspection:
First, the goverment gives amnesty.
second, this person applies and is granted amnesty
third, you can marry and have as many children as you want.

okay this is how the system works.... first you get married ..then you file an application with immigration to sponsor your spouse....( i recommend you get a lawyer to process the who things)...few months later ...you and your spouse is called for an interview...at this interview they will ask you basic questions about the two of you and ask you to provide some evidence of your bonafide marriage.....assuming they dont find major problem with your marriage..they will issue your spouse a conditional green card (expires in 2 yrs)....now conditional green card is a probationary period where you and your spouse will have to accumulate as much evidence you can to provide to immigration to remove the conditions on your spouse's conditional green card upon expiry of this conditional green card.....some of the evidence they will require are join tax return, joint bank statements, pictures, etc... once your submitted evidence is reviewed by immigration, and based on the amount and adequacy of the evidence your spouse will be given a permanent green card or you two will be called back again for another interview which is more rigorous and extensive.... so all in all....9 out of 10 times immigration doen not visit houses to confirm you guys are living together... but then again i wouldnt take that chance if i were you....its common sense that you should be living together if YOU ARE MARRIED....also you will have to be stayed married for minimum 3 yrs or until your spouse gets his/her permanent green card (10 yr card) before you can even contemplate divorce....

they do come to the home. they check things out. if you are planning on doing this don't. you can go to jail if found out.
