I am almost 3 months pregnant (I am Australian) with a Argentinan man who I am marrying next month, we have been together performing in Mexico in a big show for over a year as partners. I am moving back to Australia to have the baby, does anyone know about the immigration laws, and if he can become a resident easily, if so how long can it take? will he be allowed to come for the birth of my baby? I love him so much and I want my baby to have it's father close, but I also must be close and live in Australia close to my family... What are my options, does or has anyone been in thsi situation, what did you have to do?

Thanks

Hi there,

Congratulations!

For your partner to move to Australia he will more than likely need to be sponsored by you for a spouse visa. For a spouse visa you will need to show that you are married or have been living together for 12 months. If you do not meet either of these requirements you can sponsor him as your fiance however you will need to get married in Australia within 9 months of arriving there.

Unfortunately, having a child together will not be sufficient - you will also need to meet one of the above requirements.
