The days of chivalry are just about gone. If, in that split minute of decision-making, you could have thought of something less violent maybe you wouldn't be in prison. Anyway, can't you get a better attorney than the one you had and ask for a re-trial if what you say is the truth.

What was the charge you were sent to jail for?
Using force to prevent a violent attack is justified, even if the force results in a death. As a civilian you are not held to the same standard as a police officer might be in stopping the attack.
Now, if you yanked the rapist off the lady, and he's not fighting, and your kick him in the head and kill him. That's a no-no, and you are going to jail for that.

Brotherman!, I walked in on my ex and an employee having sex and when i defended myself against HIS attack the Judge said
" Sir, You had a window of opportunity to cease and decist but chose to put two people in intensive care, I thereby sentence you to 2yrs. in the department of corrections, good luck." The law states that reasonable force in a felony act is legal. Your Attorney sucked!! bigtime. If I were you I would file under 28 U.S.C. 2254
of the federal codes for a Writ Of Habeas Corpus and file Defective Counsel/Ineffective Counsel.

If he is not armed you are likely to get recklessly endangering safety and do some time (5 years or less) since you had no right to take his life... the fact that it was an accident will make it recklessly endangering safety and not manslaughter- which is what you'd get if you killed him on purpose.

I think this comes under excessive force. Say you try to rob me on the street and I beat the *#// out of you I could go to jail. I read about this in black belt magazine. It was saying you should only use what force is necessary to disable the attacker.

Well at least they still let you on the internet to hang on Yahoo Answers... Could be worse, some prisons don't have internet privileges. Enjoy it where you are for now I guess.

you must be in astate where their is no self defense law. many states dont have one so many women are sent to prison for the of their life for protecting themselves from their spouses years of abuse . but of the courts prioritys were straight they would have thrown the violent men in prison for abuse. life is very un fair i bet next time you will look the other way . good for you to help that woman. i hope she went to trial for defense

if you kicked him off the lady and you kept hitting him and he died that's considered murder. If you killed the man trying to get him off the lady then that's not really bad.

that sucks.....if i was on the jury i would not have convicted you...it's sad a man goes to prison for defending someone and rich celebrities who kill their wives get off scott-free. sad
