I filed bankruptcy 3 months ago and it was discharged 1-14-07. Do I have to turn over my income tax return to the trustee if I was never told to?

Not as long as the Trustee has abandoned all scheduled assets in your case and has declared your case a No Asset case.

YES!! YES!! YES!! Or you could have your whole bankruptcy overturned. You do not want that. To be on the safe side, send a copy of your return to your atorney and trustees office. Do not spend any of it because most likely you will have to turn it over to them, or at least a portion of it. I am going thru same thing and have been warned by both the importance of it. I also knew of someone you went thru bank. and did not report tax return and had the whole thing overturned even after discharge along with a nice hefty fine. Be Smart!

Not if it's after the discharge date and wasn't listed as an asset in the bankruptcy case.

You shouldn't have to. You filed and received your tax return "after" your bankruptcy was discharged. Check with your lawyer just in case.
