Guess you need to seek legal counsel, but I think that they usually lean towards the mother whenever possible so I don't know how much you can do unless you can prove the mother isn't fit. However, I would definitely seek legal counsel. They will know what is possible.

I feel that initilly you may try to persuade your sister to let the child with you though she could have access to her at any time she wishes. Try to argue with her that with her indifferent backgound she would only jeopardise the child's future. For this purpose let her understand that the child's impression that you are her mother is better allowed to prevail your sister taking the role of a loving aunt. This will reassure your sister who is the child's natural mother.This has worked in many cases. Try to convince her that had you not been ready to wield the responsibility the only altenative would have been an abandoned child's home for her. May be if she still insists then displomatically tell her that if the child were to come back to you you may not be in a position too accept her and then the Poor House would be the only destination. Unlss your sister is a fool or is out to emotionally blackmail you she will relent.Courts normally take a traditinal view that the natural mother is the best guardian of a child .

Please for the sake of your niece protect her and get an attorney. If you already have Legal Guardianship then ask the judge to grant the mom to be on a program to follow, parenting class, drug tests, so on whatever the courts see fit to prove herself. It will ease your mind knowing her intent to clean her act up by showing it or not. Otherwise you'll lose her. Go to Court tomorrow!

Fight it.
It doesnt appear that she knows whats best for her child or herself for that matter.
She wants to be a mommy when its convenient for her, well its not in the best interest of the child to be ripped from a stable home and placed into a home where criminal activitiy is going on.
I hope you win hun. That baby needs you soooo bad.

I think in a long run, if you send her back to her mother, she will have her life ruined and many more disappointments in her life. If your niece means lot to you and love her, keep her in your life, not back in her mother's life. Spare her the problems of her parents being in the prsions until she is into her adult's age.

I think you would be the best mom in this situation, but you do need to get legal advise and probably hire an attorney.

i dont think any state would put up with it...but get a really good lawyer and fight it...help your niece live a better life..obviously its not with her mother
