It depends on the state. Each state has laws that clearly spell out the elements of each degree. In the state I worked in, there were five levels. !st degree was the worst and 5th degree was the lesser charge. 1st degree normally involved penetration whereas 4th or 5th degree was for incidents such as exposing oneself, fondling, etc.

Have you heard of the 4 football players from Immokallee, Who supposedly raped a 15 year old girls. All boys were 17. If convicted they face 7-20 years in prison. The girl first reported it as a rape, then changed to consensual sex. Stiil the law states a girl under the age of 18 cannot give the ok for consensual sex, it is against the law here in Florida.

Depends on what state you're talking about, it varies with each one in a lot of respects. Normally it's the degree of violence and activities involved, the more violence and more physical contact the higher the degree of crime.

Criminal Sexual Conduct in Michigan:
1st and 3rd involve penetration
2nd and 4th involve touching
