I would do more than threaten.

You might be able to be charged with harassment.

Well, I'd guess that would be a NO, because even though YOU are making a "criminal threat" on a tresspasser, the tresspasser is breaking a bigger law by committing stalking & peeping on your wife! You should call 911 & get this on record in case anything happens in the future. Don't ever let these seemingly "little things" go, because you never know what a person is capable of doing, until it is done & sometimes a person like this can go off the deep end & hurt someone, so you should always make a report to refer back to if you need to!

theoretically yes. If you push the threat too far, and he's got a really good lawyer.

If you just said, "Get outta here or I'll kick your butt" and he leaves, probably won't go far. But if you went beyond that, starting threatening him if you ever saw him again, or threatened permanent bodily harm, you may be in a bit more trouble. It's stupid, but that's the way things are these days.

Well first of all, he can be arrested for trespassing & under the 'Peeping Tom Law' most states have. You could be charged, but unless your comments were in front of a witness that will testify against you, or a police officer, nothing will happen to you.

You can remove them from your property using whatever force is reasonable but you can't threaten bodily harm or death. However, I don't think too many officers would charge you under these circumstances. I know I wouldn't.

trespassing may be a strecth, you would have to photograph him in the act.. but thats about it, but as far as threatening him, no you cannot get in trouble, and if he calls the police about your threats, the police will treat it like nothing happened....

You could both be arrested. You for threatening and he for trespassing.

if they are in your house, or on your property and are a threat to you, i believe you can shot them if you want to.
next time don't threaten to beat them up, make a promise to, you can't get in trouble for making promises.
