I see it all the time on TV. (i.e. Defendent must post $10,000 Bail.) How exactly does that work? The defendent pays $10,000 to the state to be free only until the trial date? Please explain.

Yes, you post a bail amount set by a judge to ensure that you will return to court for your hearing. Once you appear, your bond is returned in full less any applicable fees. If you use a bondsman, they will usually take 10% from you, pay the full amount to the court. When you appear for court the bondsman gets the full amount back and keeps your ten percent.

Yes and no. You can cash bail, which means that you pay 100% of the bail in cash (no checks, money orders, etc.) and upon completion of the trial or court proceedings regardless of conviction and that you make all your appearances you or whoever posted it will get all 100% of the money back.

If you use a bondsman, you give him 10% as the previous poster mentioned in cash which is gone forever. You also must typically have collateral in the amount of the total bail, i.e. your house, car, etc. which you sign over. The bondsman then turns over a certificate of bond to the jail which shows he is liable for the full amount should you skip out. He actually does not pay the money to the courts/jail until you fail to appear. Then he is liable to pay your full bond.

As long as you behave and the prosecution does not object you can actually remain out on bail beyond conviction and up to sentencing depending on the charge.

when the commisioner sets bail you can call the bail bondsman and have them post bail. if your bail is 10'000 you would only need to pay 10% of that to a bails bondsman which will only be $100. the bail bondsman puts up the rest in a form of a bond. but if fail to appear in court they will send their bounty hunters(rent a cops, people who could not make it as cops) after you.

10,000 bail if it is cash then they pay 10,000 cash
10,000 at 10% they pay 1,000 to a bonds man to get out but you don't get it back. Now if you can pay 10% to the court then you get it back when you show up for court.

if someone is bailed out on 10,000 cash bail only do they get the money back?
