no you dont have to give it the biological fathers last name in order to get child support. your best bet would be to leave the fathers name off of the birth certificate and give the child YOUR last name. after you have a paternity test done, you can change the babys last name and file for child support from the father.

Were are you from? I'm in the UK and here we have to go the registry office to register the baby and get the birth certificate, if we don't want the father on the birth certificate he doesn't have a say, unless you're married, he can't register the birth alone unless he's married to you or unless you go along with him. I done the exact same thing, my babys father is unstable like your ex, i let him be there for my son, but supervised so that i know my baby is safe, i never let him sign the birth certificate just incase he tried anything and he had rights, i want the law to be on my side too. You don't need him to go on the birth certificate if you don't want him too, if he really cares about the baby he won't care about being on the birth certificate, in my opinion seeing the baby and being in the babys life is more important than what a piece of paper says.

You have to do the paternity test before either sign. Unless they don't know what's going on and you have the one you think is the father, sign the birth certificate. Not a good idea. Wait and see. Usually you can have a professional test your child and the two men the day your child is born. Not sure how long the results take. Anyhow, after you've proven who's the father, child support can be claimed.

It may be that different states do it differently, but in our state (Michigan) only one parent signs the birth certificate and that is usually the mother. You do not have to fill in the name of the father on the birth certificate, especially if you are not sure who it is. I would suggest that if you are not sure who the father is that you leave that information blank, give the baby your last name, and let a lawyer handle the child support issue. Again, each state may be different, but I do know that if an unmarried woman has a baby and wished to collect child support, she must petition the court for it. All child support is mandated through the court system. It will be the man's responsibility to have the paternity testing done if he does not believe the child is his. The men who you think may have fathered your baby must agree to voluntary DNA testing to find out who the father is. This testing is expensive and you will have to pay for it unless the men agree to pay part of it.

Perhaps I am wrong, but I was told by a friend of mine, who got pregnant off a one night stand, that she could not put a father's name on the birth certificate until either he signed it, or she had a paternity test done proving he was in fact the father. She said that the hospital told her that since she was not married to the guy, only he could put his name on the birth certificate. Luckly the father in her case did sign it, but the hospital told her that had he not signed, she would have had to get a DNA test to prove he was the father, before his name could have been listed as the father. They told her that the reason for this is so that women can not try to "pin" fatherhood on a man who might not be the father of her child.
That said, yes you do have to give the fathers last name to get child support. No judgement here, but how do you think that they would garnish his wages without his last name and social security number? Of course they have to have the last name. You couldn't just say "It was this guy named John who raped me." and the courts know who John is. Perhaps I am confused by your question, but it sounds like you asked about giving the courts the guys last name, but if you are asking about giving the child the guys last name, then no the child doesn't have to carry his last name to be eligable for child support.
The hospital is probably the best to tell you about the birth certificate though. You might have to list the father as unknown, until you determine paternity and then yes you could change the fathers name as well as the childs last name. But honestly, why would you want your child to have the last name of the man who raped you?

Use your last name (it may need to be your maiden name, not a married name) and don't name a father until you have a DNA test done. Just leave it blank or put unknown.
No the child does not need to have the biological fathers last name to collect child support. They only have to share DNA.
My sister-in-law was in the same situation (not raped, but 2 possible fathers) She gave her daughter her last name. When she filed her petition for child support they DNA tested both potential fathers and went from there. She never changed her child's last name, it stayed the same. She has no problem collecting.

You don't have to put a father's name on the birth certificate (and, if you're not married, you can't put one on without an affidavit of paternity or DNA test). Give the baby your last name, you're the one the child is going to have the most connection with. The child does not have to have the dad's last name for child support, but without the affidavit or DNA test you won't be able to collect child support.

Do not put anybody. You need to get a dna test to find out the paternity. It can be done right now or once the baby is born. You do not need the father last name in order to collect child support. but you really do need the dna test done. Have potential fathers get tested. Get the rapest in jail right away.

My question would be - if you were raped why do you want to have the fathers name on there anyway?? It isn't a requirement to list the babies father.
As for child support - the baby can have whatever last name you give him. But you need the fathers full name, social if they can't find it and his address for the child support agent....
Is it me or is this sound like a very strange question? I mean..if I was raped, and I knew who the father was...that a*hole would be in jail. If you have a suspicion get a blood test done, the judge can order one.

You can write in there that the fathers name is unknown...no you don't have to use the biological name for child support. Give it your last name...if you know who the father is you will need to get DNA testing done to prove he is the father, to go after him for child support.
