He owes taxes for not claiming a job and now we did them seperate. That was in 2004 and i was just a joint applicant

Your refund cannot be touched for HIS debt if you file separately. However, if this is for a year when you filed a joint return they can attach both of your refunds because you are both liable for the taxes for that year.

You can apply for relief by filing an Injured Spouse Allocation form. You should file a paper return and attach it to your return.

If you filed a joint return for the year that had the problem due to something not being claimed, then you are most likely jointly responsible with him for the debt, and yes, they could take your refund.

You might be able to try to claim the Innocent Spouse provision (not the Injured Spouse - that's different) but probably would not have a lot of success with that. Innocent spouse says you had no way of knowing about what was left off, and didn't in any way benefit from it. Injured spouse says the debt is not yours so your part of a joint return should not be taken - in this case, the debt IS yours even though the amount left off the return was his income.
