I pay all her utilities, and provide her with additional spending money, it totals about 400.00 a month, my sister has her as a renter paying no rent in lieu of babysitting and other activities. Can we both claim her or which one can claim her legally?

Only married couples may claim a dependent together. However, since you pay expenses, you could claim her as a dependent. Since your sister pays for the house, she could claim Head of Household. Both are significant tax breaks.

Depends on who provided MORE THAN HALF her support. You find this out by adding up all the SUPPORT expenses and see who provides more than half.

In lieu of this, the IRS has a form for situations such as yours, whereby you and your sister can AGREE on who claims her as dependent. You BOTH fill out and sign the form and submit it with your return.

No you both can't claim her. I guess she is living with your sister and it looks like she can claim her. But you might want to contact H&R Block or some other tax place to find out.

out here where I live only one can claim her and that is the one she lives with, and you would have to make more than her. on the tax form. but you can always ask the person who is going to do the taxes. good luck.
