Mid December I took a job in which I home office (live and work) in KY. My employer is in PA. There was a mistake and my only 2006 paycheck from this co. covering one week of work withheld PA taxes instead of KY. Since I neither work nor live in PA I shouldn't pay PA taxes on this income but I should pay KY taxes. But somehow I need to get the money PA has in its pocket over to KY. How can I do this? (Employer says at this point they can fix 2007 retroactive to the beginning of the year but that one week of income that shows as PA can't be fixed.)

the first answerer is correct. what you'll be doing is filing for a refund. we have that happen a lot(i work for md) where employers accidentally withhold the incorrect state, and the taxpayers just need to file with that state and show that none of their wages were earned there and you'll get a refund.

There's really nothing for the company to fix at this point. You should ALWAYS check your paystub and verify that the withholdings are correct. Had you done that when you got your first paycheck they could have fixed it easily. It's too late for that now so you'll have to go it alone. Here's what to do: File a non-resident PA return showing $0 income and the taxes withheld. (You may wish to attach an explanatory note.) You'll receive a refund of the taxes withheld for PA. File your NY return and pay the taxes due. NY may assess penalties for underwithholding. There's not a lot you can do about that, however, as you had all year to check your paystubs and have the mistake corrected but didn't.

File a Pennsylvania return and you should be able to get the withholding back.
