Question

I'm a pre-op transsexual, but my license says female. I've been living as a female for almost 11 years. I went fulltime when i was 14 and when i was 16 went for my permit and they put female on it. I was born in indiana and they don't have sex on the birth certificate. So i've been with my boyfriend for 2 years. He wants to go to vegas and get married. Technically i could because all vegas needs is a valid ID . and mine says female. I love my boyfriend more than you could know and i want to marry him. but my question is should i risk it ? legally it is fraud .i might be fine. it's not like they are going to look under my dress. but fraud is a federal offence i could go to prison. But david's the one for me and i want to get married , what should i do ?

This is a fascinating case.

The real issue would not be fraud but would be whether the marriage would be technically valid. If you were to get divorced, either of you could simply seek to assert that the marriage was not valid. The issue could also arise with regard to taxes if you claimed a marriage deduction.

This is a very grey area of the law right now. Your best bet, to ensure that everything is considered legal and valid by your state would be to wait until you have had the surgery.

Otherwise you could go to a state that has same sex marriage and whether the state determines if the marriage is between a male and female or a male and male would no longer matter.

Wow that is a tuff one, unfortunately I cannot offer a valid answer, get married, and do everything that pertains to taxes or such as if you two were single. I really think that the biggest issue is if the marrage would be considered valid. No matter what, I wish the two of you the very best, and good luck to you.
