He can file Head of Household based upon his daughter. He can claim her as a dependent. (It would be pointless for you to do so as you didn't work all year and have no tax liability or earned income.)

He MIGHT be able to claim you as a dependent as well if you lived together all year, YOU had less than $3,300 in gross income and he provided more than half of your support.

He should also be able to claim the Earned Income Tax Credit since he has a qualifying child. This can be several thousand dollars.

Based upon the information you've provided, he should get back all of the $1,175 withheld, plus $2,797 for the EITC, for a total refund of $3,972.00. If he doesn't claim you as a dependent (though it looks like he can) his refund will be about $100 less.

My question to you, are you a creature of the law or a natural person? If you are a "natural person", then you do not have a "tax liability", which is the main requisites for paying "income tax". The "income tax law" does not include "natural persons" since we are the rightful owners of this Country, and as such can NOT be taxed by that which "We, the People" created. Go to the I.R.S. web site to learn more about how they operate as a collection agency for a debt incurred by our elected representivies without the peoples authorization. FYI, the I.R.S. is not part of the United States Government, but merely a foreign Corporation, chartered in Puerto Rico by foreign Banks. Have a nice day, and good luck.

He can file "single" and you can file "head of household".

The deductions you get are your standard for head of household, two exemptions, child tax credit, additional child tax credit and earned income credit. You can also take the child and dependant care credit if you used a daycare.

Just with this information, it looks like your refund will be well over $2000 even without EIC. If you want to, you could give yourself a raise and file a new W-4; it looks like it's wrong. You should be filing as "head of household" and two dependants. It sounds like you filed as "single" and one or "single" and zero.
