when pulled over the officer said it was for speeding but i wasn't speeding. He never gave me a ticket for speeding but gave me a ticket for no insurance and no operators license. dose he not have to give you a ticket for what he pulled you over for. the car was not even mine so how can he give me a ticket for no insurance.

You are talking about "probable cause." That is tough to work on a speeding ticket. First he does not have to give you a ticket for what he pulled you over for. He can logged it down as a "verbal warning." As for the actual speeding, you can take it to court to have the tickets thrown out because you were not committing the act you were accused of doing. There are a couple of things wrong though. First the officer can say that you looked "suspicious" or that you matched the description of somebody else who was being sought. They can basically say anything so that the judge will allow the traffic stop and being that it is a simple traffic stop, the judge will be more inclined to allow it.

Secondly, why put up the fight for something you might not have a chance of winning? It will cost a lot for a lawyer and lost work to submit that defense. The best thing to do is to take the proof of insurance and your driver's license (if you have either) to the court and see if the judge will give you a break.

You were possibly going to be cited for three offenses, and you are complaining that he only cited you for two? Might it be that he just felt you might be fined for driving without a license and proof of insurance, and you didn't need a third fine for 10 mph over the limit on top of the others?

No. He did not have to give you a ticket for speeding. Maybe it was a judgment call, and it was not significantly over the limit. But even if you were found not guilty on the speeding, once he stopped you and you didn't have a license or proof of insurance, and it wasn't your car, you were obviously guilty of those other offenses, and there was no way you could plead not guilty on those charges.

Since you were driving a car not your own, without license and insurance, you were just lucky he didn't arrest your sorry butt for suspicion of stealing the car, too . How did you get out of that, or was someone else in the car with you who had a valid license ?Amazing.

They can pull you over for speeding and then give you a ticket for some more serious infraction. Having no insurance is a lot bigger infraction than speeding, so is driving without a license. The fact that the car was not yours does not matter, you were the operator at the time and it was your responsibility to either see that it had insurance or NOT drive the car.

Pony up $300 for the fines.......

Every state is different as far as the insurance goes. And you did not having a DL in your possession I assume? Because if you just don't have a DL then in most states you would be arrested and your vehicle impounded. But since you're not in the bed and breakfast then you have one, but you didn't have it on you. In that case what you should do is go to court. Tell the judge you forgot, or misplaced it, or what ever you want to make up for not having it on your person, and you might get away with it. And an officer doesn't have to give you a ticket for what they stopped you for. What the reason is for being stooped is just that a reason to stop you.

You still have to be insured to drive a car. You can get insurance even if you don't own a car. It sounds weird, but it is true.

Yes, he can give you a ticket for something else even if he did not ticket you for speeding.

still if u have a license u need insurance is illegal to drive without insurance but him pulling u over wen ur not speeding is wrong so the officer is wrong.

pay the ticket. You didn't have a license, you were driving a car that was not legal. Pay the ticket, you are trying to fight a loosing battle.

You have to have proof of insurance even if its not your car. You probally need to go to the courthouse and show your liscnese and some proof of insurance even if its for another car it may be ok.

nope its up to the cop what s/he wants to ticket you for. or if they want to at all. they can pretty much get you for anything.

REALLY JUST HOW STUPID ARE YOU?? HERE YOU ARE DRIVING A CARS THAT WASN'T EVEN YOURS, NO INSURANCE, NO LICENCE, THINK MAYBE HE SHOULD HAVE JUST SAID "SORRY I THOUGHT YOU WERE LEGITIMATE?"
