It depends on who is doing the background check...If a government is doing the background check, then I believe they can find that, but if it's just a normal job and they are going thru the normal CCAP system, then I don't think they can find out anything...I think it will have the code for a felony under your name, but when the click on it, it will say that the person was dismissed on all charges or the case was expunged and so on and so on.

Yes and No. The court record was removed from the files. That's usually all that happens with an expungment. The police arrest report may still exist, but those may not be available anyway.. So might the booking record. The officer who handled the case/arrest probably still has his notes.

If the back ground check is for something like employment, the record probably will not be found.
If you have a private detective looking for dirt on you, they might dig far enough to find the record.

Upon having a record expunged, criminal, federal, etc., the only way anyone, including law in forcement, can access that record is by COURT ORDER. But under the new federal guidelines a bill to allow the F.B.I. and/or C.I.A. to maintain an open running record is in the works. However a background check should not reveil this record and if it does or your approached about it, while the record has been expunged, you have a legal recourse for invasion of privacy.

It depends on who's doing the background. If the person applies to be in a law enforcement position, then yes, a background check can find that.

If the person is applying for a police job it will be in his background check.

For all other jobs, it will not be on the background check.

If it was truly ex ponged and the paper work was filed with every department, court and FBI than it should not be found
