I was turning right out of a parking lot, and i saw no cars coming. i got stuck on a patch of ice for a few seconds, and once i regained control i was fully facing the direction i was turning. I was rear-ended by a woman driving the same direction as me but behind. She claims that I came out too fast, but when you look at the damage the middle/driver side of my rear bumper is cracked and the middle/passenger side of her front bumper is cracked. I have heard that accidents where damage is done to the rear of one car and the front of another is always the fault of the person in the rear. Would this be true in my case?

we didn't call the police. at the time i thought it was my fault, stupid of me i should have called either way. we both have the same insurance company, and we're having an appraiser look at our cars.

i was only on the ice for maybe 2 seconds tops, and before i started turning i didn't see her on the road. i was actually driving straight for a second or two before i was hit, so i believe she should have had time to stop. sucks she has a mercedes and i have a miata.

That is not always true. Especially if you were stuck on a patch of ice. It is hard for a layman to figure out what exactly happened during the accident based on damage to the car. This is best left to the insurance adjuster. If the entire road had ice patches?? Who knows?? If you were stuck on the ice though, my guess is you were at least partially at fault. (Not on purpose) but you likely lingered a little longer than you should have. Tell the insurance company the truth and they will handle it.

Read your update. Bummer you never called the police. You kinda screwed yourself there. And again by assuming you were at fault. Of course, not trying to sound negative, but your gut reaction is usually right. I am thinking, if that was your feeling, you probably were wrong. Like I said, a true bummer. But we all make mistakes. Hope your car is ok and insurance pays for it. Does not sound like anyone was injured. Very, very lucky!!

I don't know, but it sounds like she wasn't watching in front of her. People pull out in front of other people all the time in busy cities, and it's no big deal.
