He's speaking the truth of the Bible.
I don't refer to myself as a homophobe. I am really a sinphobe.
God bless.

Certainly the preacher should set the high standard for his congregation / parish teaching good morals. However, as any good leader, it should be stick but kind. The Catechism of the Catholic Church says:
"2358 The number of men and women who have deep-seated homosexual tendencies is not negligible. This inclination, which is objectively disordered, constitutes for most of them a trial. They must be accepted with respect, compassion, and sensitivity. Every sign of unjust discrimination in their regard should be avoided. These persons are called to fulfill God's will in their lives and, if they are Christians, to unite to the sacrifice of the Lord's Cross the difficulties they may encounter from their condition."
If the preachers speech specifically called to harm the homosexuals, then it is a hate crime. Same as if the preacher said to go and harm all car thief's ... (invoking a hate crime). Or if the preacher told his congregation to make eunuchs of the pedophiles listed on government pages.
But if the preacher said "God's got a better plan for those who perform homosexuals acts ... God's got a better plan for car thieves ... God's got a better plan for pedophiles ... and you get to God's plan by following the word of God" .... well, that's not a hate crime.

No, the U.S. Supreme Court has made it clear that a "hate crime" would be advocating violence (and even then, it has to be a specific act of violence against a specific person or group of people). It is NOT a hate crime to simply hold an unpopular belief or express an unpopular opinion.
Is it a hate crime for you to say that your professor is a jerk for giving you a D? Obviously not, but it would be a crime for you to encourage people to grab a bat and hang out at the teacher's lounge to attack anyone who showed up.

He is allowed to preach his views in his church, as long as he does not incite anyone to violence or other crimes. It's a private organization, and his audience is there by choice, so he's allowed to say whatever he wants (as long as it doesn't encourage anyone to crime or violence).
I think "hate speech" is more public and encouraging of bad actions, ie "Martians ought to be kicked out of the solar system, they're just spawn of Satan." If the preacher took his message to a public forum, such as television, print, or the street corner, then his message becomes public, and his right to free speech must be limited to respect other people's right to not be harassed, hear cuss words, etc.
His views are still hateful, but that doesn't necessarily make them a crime.

We are all protected by law to speak. We are also have the right to worship any way we choose. So in that context preaching against homosexuality is not a violation of the first amendment. But hiding behind the constitution to advance ones hateful feelings may not be against the letter of the law but may be against the spirit of the law.

No, it's called morality. Is putting a video content rating on movies a hate crime??
P.S. Legally (in America), a person can suffer consequences if his speech intentionally incites imminent violence. If not, then it is acceptable.

If it's the person you hate then it would be a hate crime, but if it were the action, then it's not.

Technically, but no one's gonna go arrest him for it. With religion, you can do practically anything and support it with scripture.
