received his State Tax refund back. Today in the mail a 1099-MISC form came, showing earned income for the 2006 Tax Year. My question is this, I know I am gonna have to file this for him but not sure what kinda form to use. Everytime I pull up 1099-Misc, I keep getting the small receipt type paper, like his employer had sent him showing what he had made. I need the actual Form to use, for his business write offs, and showing the income he had made?? Can I get these forms from the Library or anywhere on the net?

To STEVEN F's comment s below. FYI he is my Fiancee and not my husband. Also he was employed by an (EMLOYER) all year who did take taxes out on him. He had did a small job on the side over a year ago, and forgot all about it, until the 1099-MISC came in the mail today. When I did his taxes if I had known there was more to file, I would have certainly waited until I had the 1099. It certainly makes it easier. As for your smart alleck and judgemental reports. I suggest you take a Class on Manners!!

You need to file an amended return on Form 1040X. You'll also need Schedule C or C-EZ to account for the income and any business expenses. You'll also need Schedule SE to calculate any Self Employment tax, but only if the net amount was $400 or more.

You can download all the forms at the IRS website. http://www.irs.gov You can fill them in using your computer and save and print the completed forms.

If you're using a commercial tax prep software package such as Tax Cut or Turbo Tax, the program can handle the whole thing for you.

You have until April 17, 2007 to complete this and pay any additional tax due (there probably will be some tax) without any additional penalty or interest.

You'll also need to file an amended state return. Go to the state's tax department website and look for the forms and instructions there.

First, you should have kept better business records so you would have known you were missing the 1099-Misc. Second, If you had proper business records, you would have already included the amount from the 1099-Misc when you filed the first time. Since you question implies your husband is self-employed and doesn't know how to file self-employment taxes, I recommend professional help. Once you determine how you should have filed in the first place, you will need to file a 1040X with the IRS. The state form for amended return depends on the state, but the name is usually the name of the state tax from with an 'X' at the end.

You need to file a return -- if you don't the risk is that the IRS will seek a collection and you may be arrested if you come back to the US. I recommend you search for check stubs from the employer...the check stubs should show wages paid plus the amount withheld. It is a criminal offense for an employer to withold taxes and then not report & remit to the IRS. The IRS will aggressively pursue the employer if this is what has occurred. To protect yourself you should: 1. Pull all of the check stubs you can locate -- at a minimum my hope is you will have the final stub for 2006 and it shows total wages & withholdings for the year 2. Contact the IRS at the number listed on the weblink below -- they will assist you in protecting yourself 3. File your 2006 tax return -- you will be assessed a penalty but if you document everything and send a request for an abatement of the penalty when it is assessed it is likely that the IRS will waive the penalty. 4. NOTE: the IRS does provide a 10% reward for reporting on tax cheats -- ask about this when you speak to the IRS. Good luck.

For federal, you'll need a 1040X to file an amended return. You can download it at irs.gov or the library would probably have them.

For state, the form number is different for each state. Go to your state website and look for the forms for amended returns.
