I can't understand? if we live in democracy when a soldier
believe the war is wrong should be able to refuse to go to war?
we punish this officer because he believe the Iraq war
is an illegal war and he refuse to continue to serve
for this administration?
we punish this officer when the majority of politicians
do not support the own president?
what happend to the human rights?

Article 3: The right to life, liberty and security of person.
Article 5: Freedom from torture or cruel, inhumane treatment or punishment.
In my personal experience there is nothing worse to deal
with bad motivated soldier!!!

orders?? so if your commander order to you to clean up a specific house or building
and kill everybody is inside you just go ahead because is your duty to follow the orders? if yes just remember this you have to live with your actions for the rest of your life if you don't have any problems with that

well in my view a soldier is an human being
and he have the right to refuse everyhing he believe is wrong without get punish for that,, when I was in the army I refuse orders from general he do not punish me because he understand I was right!!

Soldiers have to follow orders or people die. They don't have the right to question them. Those are the rules. Can you run a war when your soldiers make up their own rules?
This officer is a embarrassment to the uniform he has put on. If you wanna be against war that's fine. The military is not the place for activist. You follow the rules once your done with you service you can speak your mind about the war. That is fine. All the rights in the world would not exist if soldiers weren't willing do die for the rights of others.
The congress voted for this war they should at least try to win it.
During ww2 British officers who refused to fight were executed.

Every soldier both enlisted and officer takes an oath to defend his country and follow the orders of the Commander in Chief. In taking this oath and abiding by it, we remove the element of personal choice or right to decide our battles. When he took that oath he was not coerced or tricked into the service. If this officer has an issue with the war, there are a number of ways to become a conscientious objector and leave the service. He can resign his commission and be reassigned as an enlisted person to a non-combatant job to serve out the term of his agreement with the Army.
He is grand standing and is a discredit to the Officer Corps of the US Army. He will be court martialed and will be punished for breaking his contract.

As an officer, he holds a commission. He gets a commission for 4 years of active duty and probably 4 years of inactive reserves. Once his time is up, he is OUT. Period. Now, if he wants to stay longer, he has to ask for an indefinite service date. If he gets that, he stays in until he either gets kicked out for failing to be promoted, for screwing up or he asks to get out. (Plus a few other reasons which I will not get into.) Now if he asked to get out, he has to give them a 6 month notice, assuming he does not have a commitment for something else, such as accepting schooling paid for by the Army (1 year), accepting a permanent change of station (2 years) etc. Since the Iraq war has been going on for quite some time, he had ample opportunity earlier to take care of his commitments and get out. As far as his refusal to go because it is "an illegal war" that is not his call. That call must come from very high up, like the Supreme Court.
I hope he likes Leavenworth and his dishonorable discharge. He deserves both.

The officer most likely received monies from the government to attend college. He had to sign a contract to receive these funds. He made a decision to go into the mil. after college most likely. Or he went through one of the Mil. academies. Either way he should be court marshaled. He could object to fighting and be placed in a supporting group. Medic, Admin, etc. That has been done many times. He will not be sent. The Mil. powers are not that nuts. His attempt to get free education and not paying the price is exposed.

The man isn't a coward he has said he would happily serve in Afghanistan. However the pentagon doesn't like the little guys saying where they will serve. So he will be court martialed and spend 4 years in jail that is the time the prosecutor is looking for. I wish the command had handled this under the table and sent him to Afghanistan instead we now have a stupid media circus where both sides will dig in and nothing will change.

Members of the military don't have the same rights that civilians do. He has to follow orders, or be court martialed. A soldier can't just say: I don't wanna go. He has to go, or deal with the consequences.

What he did was desert his post. This should result in his execution if convicted. The military makes it easy. Either take a chance on death facing enemy bullets or certain death facing ours. Which will it be? If the Army allows this guy to get away with it you are going to see a FLOOD of cases similar to this. The military is no place for a social experiment.

Right , so in your world.... soldiers would get paid to sit on their behinds during peacetime, and when war came about they could pack it in and go home....
..... You see now why what you said makes no sense at all?
P.S i understood the quesion and my answer is the same... every kid that didn't want to get shot at could say "oh i dont believe in the war" and get out of it.... That's why signing up to be a soldier (in any country) takes balls. I personally dont like occupations that i could get killed in, so i didn't sign up... in your world, i'd love to be a soldier... easy money!
P.S.S My god, if you went back in time and applied your thoughts to former wars.... we'd be speaking german right now... ha, or maybe Mongolian!!!!

In the military you don't get to pick and chose,you follow orders.
