We have a son that we know we can claim but what about me? I am a stay at home mom and I do "depend" on my husband. He claims zero every year. He does that work?

A spouse can never be claimed as a dependent. Your best bet is to file a joint return - you can do that even though only one of you had taxable income. You'll get an exemption for each of you plus the one for your son, and get better tax rates than married filing separately would give.

Claiming zero on his W-4 just controls how much tax is taken out of his paycheck, not what tax you owe when you file your return. If he has too much taken out, you get it back as a refund.

The people who said he can file head of household are wrong. That's only for people who are NOT married, but have a child or other close relative as a dependent. Married filing jointly has better rates anyway than head of household.

The way it works is during the year the exemptions you "claim" is only for figuring the amount of withholding. You are automattically "claimed" when you do married filing jointly because you are listed on the return. So your actual exemptions for the year would include both you and your husband plus any children.

2 different things. He is foolishly claiming zero on W-4 to get a larger refund ie giving govt an interest-free loan during the yr. You pay the same amt of tax just pay it sooner. When he does the tax form he does claim you & your child. Can't confuse the 2 things.

he does not claim "zero" on his taxes. he would claim 3.
but he probably has his withholding done as zero, in other
words he has told his employer to withhold taxes as if he has zero dependents. this is one strategy for overpaying so you can get a refund. you should learn to understand taxes better.
i do the same, i set my withholding to zero even though i claim myself as a dependent. which means i usually get a refund.

he cant claim you as a dependant because you are filing jointly

Yes, he can claim you. He should claim at least 2 and possibly more considering you have a dependent and he is head of household.

No your husband can never claim you as a dependent. He can file as married filing together or file as head of household.

You and he can document at the same time. in case you do document at the same time, then you could the two be claimed on the joint submitting. in case you do no longer document at the same time, then he might desire to document one at a time and isn't allowed to declare you.
