Legally, yes, but my experience has been that most banks will not deposit or cash a refund check that has been endorsed over unless both parties appear in person at the bank and both are account holders at the bank.

If you do not want to pay the high fees to cash the check, then you may very well have to deposit it in your own account. Though you could possibly try opening another account at a different bank and see if there is a shorter waiting period. I am not too familiar with banks and their procedures, but I do know that my bank does not usually put holds on checks and def not for that long- it seems excessive. Try Woodforest bank if it is in your area EDIT: Also, if the bank that H&R block uses is near you, you should be able to cash it there as well. I have never used H&R block, but I have cashed other types of checks that way.

Any check can be endorsed over to someone else. Will your bank accept it is a different question; might want to call them and check, but if it is for deposit, it shouldn't be a big problem

Yes, like Bostonian said. Except to the tax preparer. The preparer can't be party to the check itself.
